Just a few days after the US Department of Justice warned Elon Musk that his lottery for Presidential Election voters could be illegal, a?Philadelphia District Attorney has taken it a step further by suing the Tesla CEO over the initiative.?
DA Larry Krasner is suing Musk and his America political action committee (PAC) for running an illegal, unregulated lottery in the Commonwealth of Pennsylvania.
The Philadelphia DA’s office took to X on Monday with a link to Krasner’s statement:
According to NBC, the DA has accused Musk and his America PAC of duping citizens into giving up their personal information to “make a political pledge in exchange for the chance to win $1 million.”
The suit alleges this is:
indisputably an unlawful lottery.”
Under Pennsylvania law, all lotteries in the Commonwealth must be regulated.?According to media reports, however, Pennsylvania law appears to only apply the definition of a lottery “established and operated under the law.”
A federal definition of lottery law, meanwhile, applies to entrants paying a fee to participate. While Musk’s pro-Trump PAC doesn’t offer lottery wins via ticket purchase or cash donation, it does require participants to give up their personal identifying information in exchange.
